1. Who these terms are between
These terms are an agreement between [Company legal name B.V.], a company registered in the Netherlands under KvK number 91548640 with VAT number NL004899454B23 and registered at [Registered address, Netherlands] (“Booklino”, “we”, “us”), and the business or self-employed person who creates a Booklino account (“you”).
They do not govern the relationship between you and the people who book appointments with you. That relationship is yours alone. See section 6.
2. What Booklino provides
Booklino is booking software offered as a subscription. It gives you a public booking page at a web address of the form booklino.net/yourname, a dashboard for managing services, staff schedules, opening hours and appointments, automated email to your customers, and, if you connect your own Stripe account, the ability to take payments and deposits online.
We provide the service on an as-is basis and we work to keep it available, but we do not guarantee uninterrupted or error-free operation. We may change, add or remove features. Where a change removes something material that you rely on, we will give you reasonable notice by email.
3. Your account
- You must be at least 18 years old and acting on behalf of a business or as a self-employed person.
- You are responsible for everything that happens under your account, including keeping your login credentials secret. Tell us promptly if you believe your account has been accessed by someone else.
- The information you give us (business name, contact details, opening hours, services and prices) must be accurate and kept up to date.
- One business per account. Staff members are schedule-only records: they do not have their own logins, and nobody can act on your account by claiming to be your staff.
Your web address
You choose the name in your booking page link, subject to availability and to our list of reserved names. You do not acquire ownership of that address. We may reclaim an address that infringes someone else’s trade mark, impersonates another business, or belongs to an account that has been closed for more than 90 days.
4. Subscription, trial and payment
- Free trial. New accounts may approve a 14-day trial through Stripe Checkout. A valid payment method is required but is not charged during the trial. The selected paid subscription starts automatically when the trial ends unless you cancel beforehand.
- Plans. Beginner is €19 per month, Business is €49 per month and Enterprise is €99 per month, each including VAT where VAT applies — the price shown is the amount charged. Prices shown on our pricing page are authoritative for new subscriptions.
- Billing. Subscriptions are billed monthly in advance through Stripe. By subscribing you authorise us to charge your chosen payment method on each renewal date until you cancel.
- Commission. Booklino takes 0% of your booking revenue, on every plan. Stripe charges its own payment processing fees directly to you under your agreement with Stripe; we do not add to them and we do not receive a share of them.
- Failed payment. If a subscription payment fails, Stripe retries it. Your account keeps working during the retry period. If payment is still outstanding after that period, we may suspend the account.
- Price changes. We may change subscription prices with at least 30 days’ notice by email. The new price applies from your next renewal after the notice period; if you do not accept it, you may cancel before that date.
Cancellation and refunds
You can cancel at any time from your billing settings. Cancellation takes effect at the end of the period you have already paid for, and you keep access until then. We do not give pro-rata refunds for partial months, except where required by law or where we have materially failed to provide the service.
Because Booklino is a business-to-business service, the statutory 14-day right of withdrawal for consumers does not apply.
5. Payments from your customers
Online payments run through Stripe Connect using an account you create and control. Money from a booking goes directly from your customer to your Stripe account. It does not pass through Booklino, and we never hold your funds.
This means you are the merchant of record for the services you sell. You are responsible for the accuracy of your prices, for charging and remitting any VAT that applies, for issuing receipts or invoices your customers are entitled to, and for handling refunds, chargebacks and disputes. Your use of Stripe is governed by your own agreement with Stripe.
Deposits taken through Booklino are charged under the same arrangement. If you set a deposit on a service, we display it clearly to the customer before they confirm; what happens to that deposit if they cancel is governed by your own cancellation policy, which you should publish on your page.
6. Your customers
The appointment is a contract between you and your customer. Booklino is not a party to it, is not an agent for either of you, and is not a marketplace that introduces customers to you. We do not set your prices, we do not intervene in disputes about the service you provide, and we do not market to your customers for our own purposes.
In data-protection terms you are the controller of your customers’ personal data and we are your processor. Those roles, and our obligations to you, are set out in the Data Processing Agreement, which forms part of these terms.
You are responsible for having a lawful basis to collect your customers’ details, for telling them how you use those details, and for honouring their requests to access or delete their data. The dashboard does not currently provide self-service controls for exporting or deleting customer records. Contact [email protected] for assistance with an access, export, or deletion request.
7. Acceptable use
You must not use Booklino for anything unlawful, nor to offer services that are illegal in the Netherlands or in the country where you operate. The full list of prohibited uses is in our Acceptable Use Policy, which forms part of these terms.
You keep ownership of the content you put on your page: your text, your photos, your business name. You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce and display that content for the sole purpose of operating the service for you. That licence ends when you delete the content or close your account.
You confirm you have the right to use everything you upload, including photographs of people, and that it does not infringe anyone’s rights.
8. Suspension and termination
We may suspend or close an account if:
- it breaches these terms or the Acceptable Use Policy;
- subscription payment remains outstanding after Stripe’s retry period;
- we are required to do so by law, or by Stripe, or by another provider we depend on;
- the account is being used in a way that risks harm to your customers, to other Booklino users, or to the service itself.
Except where a serious breach or a legal obligation makes it impossible, we will tell you why and give you a chance to put it right. Where we suspend an account, existing confirmed bookings remain visible to you so that you can honour or cancel them.
You can close your account at any time. After closure we keep your data for 30 days so that an accidental closure can be undone, then delete or anonymise it, except where we must keep records longer for tax or accounting purposes. You can request an export of your bookings and customer list before you close the account, and we recommend that you do.
9. Liability
Nothing in these terms excludes liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, for fraud, or for intentional misconduct.
Subject to that:
- We are not liable for lost profits, lost bookings, lost revenue, loss of goodwill, or indirect or consequential loss.
- Our total liability to you in any 12-month period is limited to the subscription fees you paid us in the 12 months before the event that gave rise to the claim.
- We are not liable for the acts or omissions of your customers, for no-shows, for payment disputes between you and a customer, or for failures of third-party services (Stripe, email delivery, your internet connection) that are outside our control.
You are responsible for keeping your own record of appointments that matter to you. Booklino is a tool, not an insurer of your calendar.
10. Changes to these terms
We may update these terms. If a change materially affects your rights or obligations, we will email you at least 30 days before it takes effect. Continuing to use Booklino after that date means you accept the new terms; if you do not, you may cancel before the date without penalty. The “last updated” date at the top of this page always reflects the current version.
11. Governing law and disputes
These terms are governed by Dutch law. Disputes will be submitted to the competent court in the Netherlands for the district in which Booklino is registered, unless mandatory law requires otherwise.
If any provision of these terms is found to be unenforceable, the rest remains in force and the unenforceable provision is replaced by one that comes closest to its intended effect.
